Francisco Suarez published, at Coimbra in 1612, five years before his death, what is undoubtedly one of the greatest contributions to scholastic moral and legal philosophy, his Tractatus de legibus et legislatore Deo. It was part of his commentary on the Prima-Secundae of St. Thomas’s Summa. The complementary study of justice, commenting upon the Secunda-Secundae, never appeared, not even in the posthumous volumes edited by Balthasar Alvarez from the notes and lectures of Suarez. The omission is all the more (...) remarkable when one recalls the innumerable treatises De iustitia et iure that began with Suarez’s own predecessors and contemporaries—Soto, Molina, Lessius and the rest. This omission is now in part repaired by the happy recovery of some Disputationes on justice from Suarez’s sojourn at the Collegium Romanum between 1580 and 1585. They probably belong to the year 1584. The manuscript, a reportatio of whose authenticity there can be no doubt, begins about two-thirds of the way through the second Disputatio and goes on to the end of the fourth. The lost first Disputatio was probably on the object of justice; the second, of which we are now given qq. 11-16, is on ownership; the third, comprising only two questions, is inscribed De actibus iustitiae in genere; and the fourth, of eight questions, De habitu iustitiae. Dennett, a philosopher, and Griffin, an ethologist, have recently presented influential arguments promoting the extended use of intentional language by students of animal behavior. This essay seeks to elucidate and to contrast the claims made by each of these authors, and to evaluate their proposals primarily from the perspective of a practicing comparative psychologist or ethologist. While Griffin regards intentional terms as explanatory, Dennett assigns them a descriptive function; the issue of animal consciousness is central to Griffin's program and only (...) tangentially related to Dennett's. The philosopher's arguments are founded upon a more coherent metaphysics, but Dennett neglects to substantiate his claim that animal competences can be most readily modelled by artificial intelligence specialists when they are described in intentional terms. Both authors assume that some examples of animal behavior should not be given an intentional characterization, but neither provides adequate guidelines for the identification of cases belonging to this negative set. Si bien la cirugía es parte fundamental de la medicina y de gran relevancia en la sociedad actual, no ha sido tomada en cuenta por la filosofía de la medicina. Debido a la naturaleza eminentemente práctica de la cirugía, una indagación sistemática nos permitirá, entre otros aspectos, dilucidar rasgos generales de las prácticas científicas en las que el conocimiento tácito es esencial. Por lo que, con la finalidad de integrar a la cirugía dentro del marco general de la filosofía de (...) la medicina, se propone un primer corpus tentativo de problemas en los que puede centrarse la filosofía de la cirugía, que incluyen: cuestiones epistémicas acerca del aprendizaje de las habilidades quirúrgicas y su transformación; la evidencia utilizada en cirugía, así como la forma en la que los cirujanos validan sus intervenciones frente a otras especialidades médicas y si está justificada epistémicamente la falta de ensayos clínicos aleatorizados; finalmente se examina la forma de aprobación de los dispositivos médicos que son ampliamente utilizados en cirugía. Esto, mostrará que la filosofía de la cirugía tiene el potencial para establecerse como un área autónoma dentro de la filosofía de la medicina. (shrink)

House raids represent the genre of military acts which fall within the grey zone of war and peace ? counterinsurgency, post-conflict operations, or phase IV operations (a.k.a. Operations Other Than War) ? in which the Geneva Conventions and their Protocols may reveal protection gaps. This article reviews accounts of the execution of house raids contained in the military literature and compares them to the testimony of soldiers and observers recorded in the media. It assesses the relevant provisions of humanitarian law (...) as pertaining to the necessity, distinction, and proportionality of actions. Further, it highlights the specific human rights and humanitarian standards addressing terror, arbitrary intrusion into the home, violations of honor, and humiliation. The conclusion emphasizes the importance of taking into account gender and cultural considerations to properly address the interests of family members ? i.e., women, children, and the elderly who are most affected by house raids. Seven hundred adolescents with mean age of 15.3 years. Multigroup confirmatory factor analysis was performed to assess measurement invariance of the MSPSS scale across Chinese and South Asian ethnic minority samples. Results show that the original three-factor structure of the MSPSS was supported in both samples. Measurement invariance was supported in terms of configural, metric, and partial scalar invariance. Given partial scalar invariance was achieved, the latent mean differences were compared across samples. Chinese adolescents had higher levels of all three (...) types of social support when compared with their South Asian ethnic minority counterparts. The present study attempts to assess the measurement invariance of the MSPSS across ethnic groups in Asian society, which sheds light on future research that involves perceived social support among adolescents in Chinese culture contexts. RESUMO Este texto apresenta parte de pesquisa recém-concluída, que delineia dimensões e balizas para o que vem sendo denominado perspectiva discursiva de alfabetização. Princípios da teoria da enunciação e de estudos que analisam as relações entre sujeito e linguagem e o papel das interações discursivas nos processos de ensino e aprendizagem organizam a base teórico-metodológica do estudo, em que se analisam relatos escritos por cinco professoras alfabetizadoras durante 18 meses. Duas dimensões teórico-metodológicas de análise são trabalhadas: discursiva e indiciária. Mergulha-se (...) nos modos como a prática pedagógica é movimentada em sala de aula, em busca de indícios para descrever a situação discursiva em que foram colhidos, analisá-los e interpretá-los. A pesquisa tem como horizonte compreender como podem ser concebidas metodologias de alfabetização em que o trabalho com a vida das crianças na cultura escrita se sobreponha ao trabalho tradicionalmente realizado com foco no sistema de escrita. ABSTRACT This paper presents data from a recently finished research that outlines dimensions and guidelines for what has been named discursive perspective on literacy. Principles of the theory of enunciation and studies that analyze the relationships between subject and language as well as the role of discursive interactions in the teaching and learning processes, organize the theoretical and methodological basis of the study. We analyzed reports written by five literacy teachers for 18 months. Two theoretical-methodological dimensions of analysis were employed, the discursive and the evidential. We focus on the ways the pedagogical practice is developed in the classroom, seeking for indexes to describe the discursive situation from which they were collected, and to analyze and interpret them. The aim of the research was to understand how to construct literacy methodologies in which working with children's lives in written culture overcomes the traditional work focused on the writing system. From pre-Christian times until the present day, philosophers have discussed whether, given evil, belief in God can logically be maintained. Theists and non-theists remain unconvinced by one another's arguments. This study re-examines the question of God and evil from a neutral standpoint and claims that neither side has come to adequate grips either with the question itself or with the other side's case, chiefly because of failure to distinguish the kinds of problem raised by evil.

I argue that Metz's undertaking, in seeking a ‘comprehensive basic norm' to underpin African ethics, is similar to Hans Kelsen's postulation of the Grundnorm in his Pure Theory of Law. But African ethics does not need to be underpinned by an approach such as Kelsen's. In my view, Metz's preference for seeking to develop a Grundnorm rests upon a failure to attend carefully to the distinctness of African ethical thinking from Western ethical thinking. This failure is manifest in a spurious (...) distinction between ‘moral anthropology' / ‘cultural studies' and ‘normative theory'. It is also manifest in Metz's failure to attend carefully to the work of Wiredu and Bujo, both of whom present systematic, critical analyses of African ethical thinking while implicitly rejecting the quest for a Grund norm as being unAfrican. Continued concern for animal welfare may be alleviated when welfare would be monitored on farms. Monitoring can be characterized as an information system where various stakeholders periodically exchange relevant information. Stakeholders include producers, consumers, retailers, the government, scientists, and others. Valuating animal welfare in the animal-product market chain is regarded as a key challenge to further improve the welfare of farm animals and information on the welfare of animals must, therefore, be assessed objectively, for instance, through monitoring. Interviews with Dutch (...) stakeholder representatives were conducted to identify their perceptions about the monitoring of animal welfare. Stakeholder perceptions were characterized in relation to the specific perspectives of each stakeholder. While producers tend to perceive welfare from a production point of view, consumers will use visual images derived from traditional farming and from the animals’ natural environments. Scientists’ perceptions of animal welfare are affected by the need to measure welfare with quantifiable parameters. Retailers and governments (policy makers) have views of welfare that are derived from their relationships with producers, consumers, non-governmental organizations (NGOs), and scientists. All interviewed stakeholder representatives stated that animal welfare is important. They varied in the extent to which they weighted economic considerations relative to concern for the animals’ welfare. Many stakeholders emphasized the importance of communication in making a monitoring system work. Overall, the perspectives for the development of a sustainable monitoring system that substantially improves farm animal welfare were assessed as being poor in the short term. However, a reliable system could be initiated under certain conditions, such as integrated chains and with influential and motivated stakeholders. A scheme is described with attention points for the development of sustainable monitoring systems for farm animal welfare in the long term. (shrink)

The concept of natural behavior is a key element in current Dutch policy-making on animal welfare. It emphasizes that animals need positive experiences, in addition to minimized suffering. This paper interprets the concept of natural behavior in the context of the scientific framework for welfare assessment. Natural behavior may be defined as behavior that animals have a tendency to exhibit under natural conditions, because these behaviors are pleasurable and promote biological functioning. Animal welfare is the quality of life as perceived (...) by the animal. Animals have evolved cognitive-emotional systems (“welfare needs”) to deal with a variable environment. Animals do not only have so-called physiological needs such as the need for food, water, and thermal comfort. They also need to exercise certain natural behaviors such as rooting or nest-building in pigs, and scratching or dust-bathing in poultry. All needs must be taken into account in order to assess overall welfare. The degree of need satisfaction and frustration can be assessed from scientific information about the intensity, duration, and incidence of (welfare) performance criteria such as measurements of behavior and/or (patho)physiology. Positive welfare value relates to how animals are inclined to behave under natural conditions, in preference tests, and in consumer-demand studies. Negative welfare value relates to stress, frustration, abnormal behavior, aggression, and reduced fitness. Examples are given to illustrate how the need to perform natural behaviors can be assessed following the general principles for welfare assessment, providing a first approximation of how different natural behaviors affect animal welfare. Sometimes metaphysicians appeal to simplicity as a reason to prefer one metaphysical theory to another, especially when a philosophical dispute has otherwise reached a state of equilibrium. In this paper, I show that given a Quinean conception of metaphysics, several initially plausible justifications for simplicity as a metaphysical criterion do not succeed. If philosophers wish to preserve simplicity as a metaphysical criterion, therefore, they must radically reconceive the project of metaphysics.

The principal objective for most patients seeking orthodontic services is a detectable improvement in their dentofacial appearance. Orthodontic treatment, in the mind of the patient, is something that makes you look better, feel better about yourself, and perhaps enhances your social possibilities, ie, to find a companion or make a positive impression during a job interview. Orthodontics, as a speciality, has collectively advanced the idea that enhanced occlusion (bite) improves the health and longevity of the dentition, and as a result (...) many patients seeking orthodontic services affirm that their secondary goal of treatment is an oral health benefit. It would appear that there is some disparity between the end-user of orthodontic services and the orthodontic provider's perception of what constitutes orthodontic need. The aim of this paper is to examine two contrasting models that characterise how dentists ‘sell’ orthodontic services to patients and to discuss the conflict between professional ethics, practice management and evidence-based decision-making in orthodontic practice. The conceptual history of cognitive science remains for the most part unwritten. In this groundbreaking book, Jean-Pierre Dupuy--one of the principal architects of cognitive science in France--provides an important chapter: the legacy of cybernetics. Contrary to popular belief, Dupuy argues, cybernetics represented not the anthropomorphization of the machine but the mechanization of the human. The founding fathers of cybernetics--some of the greatest minds of the twentieth century, including John von Neumann, Norbert Wiener, Warren McCulloch, and Walter Pitts--intended to construct a (...) materialist and mechanistic science of mental behavior that would make it possible at last to resolve the ancient philosophical problem of mind and matter. The importance of cybernetics to cognitive science, Dupuy argues, lies not in its daring conception of the human mind in terms of the functioning of a machine but in the way the strengths and weaknesses of the cybernetics approach can illuminate controversies that rage today--between cognitivists and connectionists, eliminative materialists and Wittgensteinians, functionalists and anti-reductionists. Dupuy brings to life the intellectual excitement that attended the birth of cognitive science sixty years ago. He separates the promise of cybernetic ideas from the disappointment that followed as cybernetics was rejected and consigned to intellectual oblivion. The mechanization of the mind has reemerged today as an all-encompassing paradigm in the convergence of nanotechnology, biotechnology, information technology, and cognitive science. The tensions, contradictions, paradoxes, and confusions Dupuy discerns in cybernetics offer a cautionary tale for future developments in cognitive science. (shrink)
